Football Dataco Ltd & ors v Sportradar & ors [2013] EWCA Civ 27
This is the latest decision in the long-running battle between the FA and the bookmaking industry and those who supply them with information over use of information about football matches. In December 2012 the Court of Appeal heard the appeal on the FA’s database claims. In February this year the court held that database right subsists in the information gathered by the FA match watchers and held that the bookmakers infringe that right when they report from the data feed the times at which goals have been scored [2013] EWCA Civ 27. Sportradar has sought permission to appeal to the Supreme Court. The court’s ruling is very significant and gives database right to an enormously wide range of activities which are not principally concerned with creating databases at all.
