Fred Olsen Cruise Lines Limited v Carnival Plc [O-048-15]
Chris appeared as junior to Henry Carr QC on behalf of Carnival. The trade mark dispute concerned the name of Carnival’s latest addition to its fleet of cruise ships – BRITANNIA. Fred.Olsen opposed Carnival’s registration for BRITANNIA on the basis of its own registered trade mark for the same name. Carnival counter-claimed for invalidity on the basis of an earlier registered trade mark, an earlier right under the law of passing off, and for lack of bad faith. Carnival succeeded and the opposition failed.
