Nintendo Co Ltd v Sky UK Ltd & Ors [2019] EWHC 2376 (Ch)
An application for an Internet Blocking Injunction against UK ISPs. This was the first occasion on which such an order has been obtained in respect of a non-IP right. Nintendo sought protection against websites that disseminated copyright-protection circumvention devices in breach of sections 296ZD and 296 of the Copyright, Designs and Patents Act 1988. The judgment confirms the wide scope of the Supreme Court judgment in Cartier International AG v British Sky Broadcasting Ltd and applies the same threshold and discretionary criteria to non-IP wrongs as was applied to IP rights.
